Agreeing to these terms

These terms cover your use of the Muscatine Concrete website and any work you hire us to do. By using the site, asking for an estimate or booking a job with us, you agree to them.

If a written estimate or contract we give you for a specific job says something different, that document controls for that job. If you don't agree with these terms, please don't use the site or book work with us.

What we do

Muscatine Concrete is a concrete contractor in Muscatine, IA. We pour and finish driveways, patios, sidewalks, steps, garage floors, slabs, footings, foundations and retaining walls, and we also do stamped and decorative concrete, concrete cutting and foundation raising. You can see the full list on our home page.

We're based in Muscatine and work in Davenport, Rock Island, Milan and other nearby cities. The details of any job, including its size, thickness, finish and schedule, are set in the written estimate for that job. You can read more about who we are on our About page.

Estimates and pricing

We give free quotes on site, with no obligation to hire us. An estimate is based on what we can see and measure on the day we visit, and it stays good for the period written on it.

Some conditions only show up once the old concrete is out and the ground is open, such as soft or wet subgrade, which is the soil the new slab sits on, buried debris, roots or old concrete thicker than expected. If we find something that changes the work or the price, we'll stop, show you and agree on the change with you before we do the extra work.

Prices on our website, if any, are general information and not an offer. Your price is the one on your written estimate or contract.

Scheduling, weather and cancellation

We schedule pours around the weather because rain, freezing temperatures and hard heat can all weaken new concrete. If conditions aren't right, we may move your job to the next good day, and we'll let you know as soon as we can.

If you need to cancel or reschedule, please call us as early as possible. If we've already ordered materials, scheduled a pour or started work, you may owe for the costs we've incurred up to that point, as set out in your estimate or contract.

Timelines we give are our best estimate and not a guarantee. Delays caused by weather, material supply, permits, inspections or site conditions outside our control are not a breach of these terms.

Payment terms

Deposits, payment amounts and due dates are set in your written estimate or contract. Unless that document says otherwise, the balance is due when the work is complete.

If a payment is late, we may pause work until it's made, and you agree to pay reasonable costs of collecting an unpaid balance where the law allows. Iowa law and the law of the state where your property sits may give contractors lien rights on property where they've done work, and nothing in these terms waives those rights.

Your part of the job

You agree to give our crew safe access to the work area and to tell us about anything buried that we might not know about, like sprinkler lines, invisible fences, septic parts or private wiring. We aren't responsible for damage to private lines or items that weren't marked or disclosed to us.

New concrete needs curing time, which is the wait while it hardens and gains strength before it can take weight. You agree to keep people, pets and vehicles off the slab until we tell you it's ready, because using it early can cause damage that isn't covered.

Workmanship and warranty

Our work is backed by our satisfaction guarantee. If something about the work we did isn't right, call us and we'll come look at it and make it right where the problem is ours.

Concrete can develop small hairline cracks as it cures and as the ground moves with the seasons. We cut control joints, which are planned grooves that give the slab a place to crack in a straight line, but they can't stop all cracking, and small cracks that don't affect how the slab works are not a defect.

We don't cover damage caused by things outside our control, such as settling or erosion of soil we didn't prepare, drainage changes made after we leave, de-icing salts, heavy equipment the slab wasn't built for, tree roots, flooding or freeze damage from water left standing. Any written warranty in your contract describes your specific coverage.

Apart from what's stated in these terms or in your contract, and to the extent the law allows, we make no other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Limitation of liability

To the extent the law allows, Muscatine Concrete's total liability for any claim related to a job is limited to the amount you paid us for that job. We aren't liable for indirect, incidental or consequential damages, such as lost use of your property, lost income or the cost of other contractors' work.

Nothing in these terms limits liability that can't be limited under the law, such as liability for our own gross negligence or willful misconduct.

Using our website

The information on this website is general and meant to help you understand concrete work. It isn't engineering, legal or permit advice for your property, and your job's details are set on site and in writing.

The text, photos and design of the site belong to Muscatine Concrete or are used with permission. You may view and share pages for personal use, but you may not copy or reuse them for commercial purposes without our written permission. Links to other websites are provided for convenience, and we aren't responsible for their content.

Resolving disputes

If you have a problem with our work or a bill, please call us first. Most issues get settled quickly when we can come out and look at the job together.

If we can't resolve it that way, either of us may bring a claim in the state or federal courts serving Muscatine County, Iowa, or in small claims court where the claim qualifies. You and we agree to that location for any legal action related to these terms or our work.

Governing law

These terms and any work we perform are governed by the laws of the State of Iowa, without regard to its conflict-of-law rules. Where a job is on property in another state and that state's law must apply to a specific issue, that law applies only to that issue.

Changes to these terms

We may update these terms from time to time, and the version posted on this page is the one in effect. Changes don't affect a job already covered by a signed estimate or contract unless you agree to them in writing.

If any part of these terms is found unenforceable, the rest stays in effect.
